A Guide for Employers to Sponsor Foreign Workers

Employers can sponsor someone to come to Australia permanently or temporarily to fill a nominated skilled role.

 

Visa options for Sponsoring Skilled Employees

Temporary Skill Shortage Visa (subclass 482)

1-4 years

  • Workers can only work for you or an associated entity unless exempt from this requirement
  • Workers must work only in nominated occupation
  • You can't change the occupation without a new nomination
  • Worker must have the skills to perform the nominated occupation
  • Worker must have 2 years work experience in the occupation or a related field

Employer Nomination Scheme (subclass 186)

Permanent

  • No geographical restrictions
  • The employment will be for at least a period of 2 years after visa grant
  • Direct Entry stream applicants require a skills assessment (unless exempt)
  • Relevant registration or licensing must be held if required

Regional Sponsored Migration Scheme (subclass 187)

Permanent

  • Work must be in a regional area
  • The employment will be for at least a period of 2 years after visa grant
  • Relevant registration or licensing must be held if required

Skilled Employer Sponsored Regional (Provisional) visa (subclass 494)

5 years

  • Work must be in a designated regional area
  • The employment will be for at least a period of 5 years after visa grant
  • Employer Sponsored stream applicants require a skills assessment (unless exempt)
  • Relevant registration or licensing must be held if required

Employer Guide to Sponsor Employees

Company specific labour agreements

The company-specific labour agreement is for an employer where:

  • a genuine skills need is not already covered by an industry labour agreement
  • a Designated Area Migration Agreement or project agreement is not in place

 

Evidence must demonstrate an exceptional need that cannot be met by Australian workers.

 

Provide evidence include:

  • of the niche skills you seek from overseas
  • of your many and diverse recruitment efforts
  • showing a detailed job description including tasks

 

The skilled overseas workers generally must:

  • have at least 2 years of relevant work experience
  • meet the ANZSCO skill requirements for that occupation
  • meet any industry registration or licensing requirements
  • Workers from overseas must meet the English language requirements of the short-term stream of the Temporary Skill Shortage visa (subclass 482)

 

The salary and employment conditions of the Temporary Skill Shortage visa (subclass 482) and Skilled Employer Sponsored Regional (Provisional) visa (subclass 494) must be met.

 

Be an Australian business with good standing:

 

Employers or Businesses need to show that the business has been lawfully and actively operating in Australia for at least 12 months.

 

Evidennce include:

  • show evidence of financial viability provided by a chartered or certified practicing accountant. You must show that you can support the proposed number of workers from overseas you seek
  • show that there is no adverse information about your business. You must not have broken a law in any jurisdiction of Australia, nor be under investigation for breaking the law by any appropriate authority
  • not be insolvent
  • not have provided false or misleading information in any form to any appropriate authority at any time
  • show you have consulted with industry stakeholders
