What is a Skilled Nominated Visa 190?
A Skilled Nominated Visa 190 is for skilled employees nominated by the Australian state/territory government. It’s a permanent visa based on a points test.
6 Key steps to apply for NSW Skilled Nominated visa (subclass 190) in 2022
NSW nomination for the Skilled Nominated visa (subclass 190) is by invitation only.
To be successfully nominated by NSW for this visa, you must:
- Ensure you are eligible for the Skilled Nominated visa (subclass 190)
- Confirm you meet the NSW minimum eligibility criteria
- Complete an EOI in SkillSelect
- Be invited to apply during an invitation round
- Apply for NSW nomination within 14 days
- Provide evidence for all points claims in your SkillSelect EOI and where you currently reside
*Evidence for skilled employment after obtaing skills assessment
If you have a valid skills assessment, which has assessed your skilled employment, you do not need to obtain a new assessment to demonstrate your employment occurring after you received your assessment.
You can demonstrate your further skilled employment with evidence such as;
- employment letter of offer,
- employment contract,
- payslips and
- employment reference letter detailing the duration of your employment, the hours worked per week and duties performed.
Minimum eligibility
To be considered during a NSW invitation round, you must:
- be eligible for the Skilled Nominated visa (subclass 190)
- submitted an EOI in SkillSelect
- have a valid skills assessment in an occupation that is within an ANZSCO unit group identified on our NSW skilled occupation lists page
Residency eligibility
*Onshore candidates
If you are residing onshore, you must be currently residing in NSW and either:
- have genuinely and continuously resided in NSW for the past three months, or
- be gainfully employed in a long-term capacity in NSW in your nominated (or closely related) occupation for a minimum 20 hours per week
SkillSelect point score
You must be eligible to claim at least 65 points in your SkillSelect EOI.
Age
You must be under 45 years of age to apply for the Skilled Nominated (subclass 190) visa.
English language
You must have at least a competent level of English (or equivalent).
If you are a citizen of the USA, UK, Canada, Republic of Ireland or New Zealand you are not required to complete an English assessment.
Common reasons 190 applications are declined after being invited to apply
Wasn't eligible to claim all the points in their EOI
It is the responsibility of the EOI owner to ensure they can provide evidence for all the claims in their SkillSelect EOI.
Does not meet the residency requirement
If you are applying from onshore, you must you must be residing in NSW on the day you are invited to apply, and:
- have genuinely and continuously resided in NSW for the past three months, or
- be gainfully employed in a long-term capacity in NSW in your nominated (or closely related) occupation for a minimum 20 hours per week
If you are applying from offshore (in an eligible occupation), you must:
- have continuously resided offshore for the past three months.
Over-claimed points for employment
If your skills assessment displays a date you have been deemed skilled in your occupation, you cannot claim points for skilled employment before this date. This particularly applies to ACS and most VETASSESS assessments.
To ensure you are eligible to accept your NSW invitation, we strongly recommend you confirm you are eligible to claim all the points in your EOI, and that you have only claimed eligible skilled employment. If you have claimed points in error, you are not eligible to accept your NSW invitation if invited. There are no exceptions for any reason.
